Ruidoso Cabin Rental Policies

I. TRUST ACCOUNT/HANDLING OF FUNDS AND PAYMENT PROCEDURES
    1) Condotel Corporation may receive income from services to tenants,      
   
including, but not limited to, cleaning services, telephone services and trip
    insurance.
    2) There will be a $50.00 fee for all returned checks. Returned checks will not       
   
be re-deposited. Payment is due within 2 days by certified funds or cash.
    3) On Check-in Day, any balance due must be paid by certified funds, cash
    V
isa, MasterCard, American Express, Discover or travelers’ checks before         
   
occupancy of the premises. No Personal Checks accepted.
    4) MasterCard, Visa, American Express and Discover cards are accepted for
   
Late Minute Reservations and Internet Reservations.
    5) Tax rates in effect at the time of the printing of this agreement. Tenants
    are responsible for paying the tax rates in effect at the time the occupancy
    begins.
    6) Rates and figures herein are subject to correction due to human or
    computer error.

II. CHECK-IN POLICY

    1) Check-in time is 4:00 P.M. Condotel Corporation will diligently work to insure
    that all properties are clean and ready for occupancy by 4:00 PM. However, in
    certain situations, it may be necessary to delay occupancy until the property
    is ready. There are no refunds for late occupancy. Please do not go to the
    property before checking in at Condotel Corporation. Parking at the property
    prior to check-in time without the approval of Condotel Corporation will likely
    delay the cleaning and inspection services and delay your check-in. A limited
    number of early 1:00 PM check-ins will be offered for guests with special arrival
    needs. The cost to guarantee a 1:00 PM check-in is $50.00. Two keys
    provided per rental unit upon check-in. Additional keys – refundable $50.00
    deposit. Lost keys - $50.00 each set.
    2) Checkout Policy: All properties must be vacated by 11:00 AM sharp on
    checkout day or guest may be subject to a late checkout fee of $50.00 per
    hour during the summer and winter months. A limited number of late 12:00PM    
   
checkouts will be offered to those guests with special departure needs. The
    cost for a late 12:00PM checkout is $50.00. Please follow posted checkout
    instructions and return all keys to Condotel Corporation. If the checkout
    instructions are not done upon departure, or if the unit is left dirty there is an
    extra charge of $50.00 plus tax

III. SECURITY DEPOSIT
    A credit card is required on all reservations for security. If there is any damage
    or missing items, the credit card will be billed accordingly. We can not accept
    debit cards for the security deposit.

IV. RENTAL PROPERTIES
    1. All units are individually owned and furnished according to the owner’s    
   
preference with each consisting of the standard appliances of range,
    refrigerator, cookware and dinnerware. Linens are furnished.
    2. There will be NO REFUNDS due to any breakdown of appliances, A/C
    systems, TVs, VCRs, phone or other electronic equipment. Please report any
    problems and Condotel Corporation will contact a repair service technician
    immediately. Your patience will be appreciated as our area has limited repair    
   
service contractors. NO REFUNDS allowed due to any loss of utility services.     
   
Please contact Condotel and we will report the outage to the proper utility
    company. Tenant is required to report in writing to Agent the need of
    replacement or repair to a smoke detector and agrees to replace batteries as
    needed during tenancy (batteries will be provided by Condotel). Please test
    smoke detectors on arrival
    3. All of Condotel Rental Properties include departure cleaning. Tenants are
    expected to dispose of all items in the refrigerator and place all trash outside in
    dumpsters. Failure to do so will result in an additional charge of $55.00 plus
    tax.
    4. Telephones are provided in all rental units for the convenience and safety of
    tenants. The first 120 minutes of long distance and/or internet service is
    provided to the tenant. Any and all charges, including internet services, over
    the initial 120 minutes that are billed to the owner’s phone will be billed to
    tenant or deducted from tenant’s security deposit or charged to tenant’s
    credit card plus a $20.00 service charge.
    5. Many properties contain a Guest Book provided by the owner for tenants to
    share their vacation experiences. Maintenance issues and/or needed repairs
    are not to be reported in the guest book. Condotel Corporation assumes no
    responsibility for property maintenance issues written in a guest book. All
    maintenance problems should be reported directly to Condotel Corporation.

V. ACCOMMODATION RULES
    6. Agent agrees to provide the premises in a fit and habitable condition. If at
    the time Tenant is to begin occupancy the Agent cannot provide the premises
    in a fit and habitable condition, or substitute a reasonable comparable property
    in such condition, Agent shall refund to Tenant all payments made by Tenant.
    Agent shall conduct all brokerage activities in regard to this agreement without
    respect to the race, color, religion, sex, national origin, handicap or family
    status of any tenant.
    7. Tenant agrees to keep the premises as clean and safe as the conditions of
    the premises permit and herby agrees to permit no unsafe or unsanitary
    conditions on the property. Tenant agrees not to use the premises for any
    activity or purpose that violates any criminal law or governmental regulation.
    Any breach of any duty contained in this paragraph shall be considered
    material, and shall result in the termination of Tenant’s tenancy.
    8. ABSOLUTELY NO PETS unless otherwise specifically permitted in this
    Agreement. No pets shall be allowed on the premises. Tenant’s breach of this
    provision is considered material and shall result in the termination of Tenant’s
    occupancy and a $200.00 fine will be charged. A penalty of $200.00 will be
    levied for all un-disclosed pets.
    9. NUMBER OF OCCUPANTS: Overcrowding will not be permitted. Extra bedding
    is for the convenience of the owner and not for additional guests. Condotel
    Corporation does not discriminate on the basis of race, religion, ethnic
    background or national origin, sex, age or mental or physical disability.
    Condotel Corporation will not rent property to anyone under the age of 24, nor
    will Condotel Corporation permit anyone under the age of 24 to take possession
    of any rental premises without the physical presence of a responsible party
    who is at least 24 years of age. Condotel Corporation will rent to non family
    groups (persons who are not related by blood or marriage) only if group obtains
    approval from Condotel Corporation prior to taking possession and adequate
    adult supervision is maintained at all times. No House Parties are permitted at
    any time. Condotel Corporation reserves the right to terminate the rental,
    without refund, if any renter or occupant violates any of these criteria.
    Misrepresentation of the number of occupants may result in the renters being
    asked to vacate the property without a refund. Children are counted in the
    occupancy unless they are under the age of 2.
    10. GRILLS: Some owners have provided grills. Do not place wood or charcoal
    in gas or electric grills. Grills must be cleaned with the brush provided upon
    departure. There is a $15.00 fee for leaving grill dirty. If a grill is misused,        
   
tenant will be billed for repairs. Not all owners allow grilling. If a grill is not
    provided at the property, you may not grill at the property. Grills can not be
    provided by Condotel.
    11. PARKING: On site parking is limited on many properties, so please limit the
    number of vehicles to two vehicles per unit to avoid parking difficulties. Please
    check with the office if you will exceed two vehicles.
    12. Tenant agrees to indemnify and hold harmless Agent and owner from and
    against any liability of personal injury or property damage sustained by any
    person (including Tenant’s guests) as a result of any cause, unless caused by
    the negligent or willful act of Agent or the owner. Tenant agrees that Agent,
    the owner or their respective representatives may enter the premises during
    reasonable hours to inspect the premises, to make such repairs, alterations or
    improvements hereto as Agent or owner may deem appropriate, or to show the
    premises to prospective buyers or tenants. Tenant shall not assign this
    Agreement or sublet premises in whole or part without written permission of
    Agent.
    13. MOTOR HOMES: No hook-up or use of any camper, bus, van, motor home
    or tent in conjunction with any rental property allowed. Motor Homes parked
    on the property must be pre approved by Condotel Corporation and will be
    permitted only if space permits.
    14. SMOKING: Unless otherwise noted, all properties are non-smoking. Smoking
    is permitted outside, unless Fire Restrictions of the Village of Ruidoso, County
    of Lincoln are in force. Please check with the office for current fire restrictions.
    If smoking outside is not banned, please dispose of all ashes and butts  
   
properly. DO NOT leave cigarette butts on the ground, deck or any place than
    a proper trash receptacle.
    10. HOT TUB: If the hot tub gets broken or left excessively dirty after your
    stay there will be an extra charge plus tax.

CANCELLATION POLICY

    Cancellation of a confirmed reservation is required in writing by mail or fax or
    email. A deposit must be received by Condotel 14 days prior to arrival, or 3
    days after the reservation is made, or the reservation is subject to
    cancellation. You may cancel 14 days prior to your arrival date, and receive a
    refund of your deposit. If you cancel less than 14 days prior to your arrival,
    the deposit will be non-refundable. NO EXCEPTIONS.
    Long term reservations, or major holiday reservation, may have different
    cancellation and refund policies. Please refer to your confirmation letter for    
   
specific policies. There are no refunds on unused lodging.

    Labor Day: Labor Day reservations must be paid in full by August 1. If you
    should book your reservation after August 1, the full payment must be paid at
    the time of booking. Cancellations received less than 14 days prior to arrival
    are not refundable. The full payment will be forfeited.

    Christmas: Christmas reservations must be paid in full by November 1. Please
    refer to your confirmation for exact payment schedules. If you should cancel
    at any time before November 1, there is a $100 booking fee charged. If you
    cancel after November 1, but before December 1, you will forfeit 50% of the
    rental amount.
    Cancellation after December 1, there are no refunds.
